Fulton County Commissioner Marvin S. Arrington Jr. Leads Support for New Property Owner Protection Legislation | Print |

Fulton County District 5 Commissioner Marvin S. Arrington, Jr. is leading efforts among city and county officials in supporting the “Community Association Protection & Transparency Act” (CAPT).   The CAPT Act legislation (House Bill 748), introduced today by District 62 State Representative William Boddie, calls for more protection of Georgia homeowner rights through better operation of homeowners’ associations (HOAs) and other community governance entities statewide.

“I’m excited about this collaborative effort with legislators around the state, and those we’ve spoken to seem to be supportive of the common sense uniform proposals contained in this bill,” says Fulton County District 5 Commissioner Marvin S. Arrington, Jr. “Our goal is to protect Georgia homeowners, so I’m happy to have the support of my legislator, Rep. William Boddie, and others at the state capitol and look forward to working with anyone interested in protecting these homeowners.”  

The proposed CAPT Act would implement rules governing the operations and structure of HOAs, property owners' associations, and condominium associations.   The CAPT Act would also require association budgets to include reserve accounts to pay for capital expenditures and deferred maintenance of property common areas and facilities.   It also details the procedure of transferring operation of associations from developers to the home and condominium owners themselves.   That procedure includes developers maintaining, and then presenting to HOAs, property owners' associations, and condominium associations, copies of the maintenance contracts set up for the development as well as all pertinent contact information, a complete list of homeowners, insurance policies in force, and any inventory purchased by the developer on behalf of the development.

The CAPT Act has already been endorsed by Commissioner Arrington as well as County Commissioners from Cobb, DeKalb, Rockdale, Douglas, Henry, and Fayette Counties.   Much of the framework of the legislation was generated in consultation with members of the Georgia HOA Alliance and the Community Associations Institute. Supporters plan to reach out to homeowners, the Georgia Realtors Association, and the Georgia State Bar’s Real Property Section for their additional input on the legislation.   Ultimately, the legislation could impact as many as 2 million Georgians who are members of community associations statewide.
